Based on Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals concerning the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter referred to as the "General Data Protection Regulation") and the Data Protection Implementation Act (hereinafter referred to as the "Act"),


DING Applications Ltd., a limited liability company headquartered in Zagreb, Otona Župančića 6, VAT ID: 52935850171 (hereinafter referred to as the "Company"),


on September 1, 2020, issues and publishes the following decision:


General Terms of Use

1. Fundamental Definitions

These General Terms of Use, together with the Personal Data Protection Policy available on the Application (hereinafter referred to as the "Terms"), regulate the rights and obligations of Employers (as defined below), Job Seekers (as defined below), the Company, and all other Application users regarding the use of the Application (as defined below), privacy protection procedures, and methods for protecting the personal data of all Application users.

By accepting the Terms or simply by using the Application, you agree to all the provisions of the Terms, including any amendments and supplements published through the Application. If you disagree with the Terms, you are obliged to discontinue using the Application, delete and deactivate your user account, delete the Application from your mobile device, and you can contact the data protection officer if you wish to have your personal data removed or to exercise your "right to be forgotten."

These Terms are an integral part of any contract that would be separately concluded between the Company and Employers and/or Job Seekers related to the subject of the Terms.

The Terms do not apply to external services that may have their link in the Application (e.g., LinkedIn, Facebook, etc.).

2. Basic Definitions

SERVICE PRICE LIST is a list of services provided by the Company, with the indication of the price in Croatian Kuna that the user must pay for the delivery of each service, published through the Application.

DING or the Application is a web and mobile application available through the website www.ding.jobs or through the mobile application owned by the Company. It serves to exchange information between Employers (as defined below) and Job Seekers (as defined below) and for the purpose of improving, modernizing, and increasing the efficiency of the labor market.

DATA PROCESSOR is a natural or legal person who processes personal data on behalf of the data controller.

USER is any Employer, Job Seeker, Business User, or any other person using the Application.

COMPETITION refers to all forms of activities in which participants compete, regardless of the topic and type of reward.

PERSONAL DATA includes all data related to an individual whose identity is determined or determinable ("data subject"); an individual whose identity can be determined is a person who can be identified directly or indirectly, especially through identifiers such as name, identification number, location data, network identifier, or through one or more factors specific to the physical, economic, cultural, or social identity of the individual.

EMPLOYER is any legal entity and/or natural person engaged in independent activity using the DING application to find employees, assignees, volunteers, interns, scientists, or for any other type of business engagement. Employers also include entities that use the DING application exclusively to promote student competitions and/or to use the possibility of publishing content for Job Seekers for educational and informational purposes.

JOB SEEKER (or Student where applicable) is any natural person using the DING application to apply for business engagement with an Employer (which, without limitation, includes the establishment of an employment contract, a contract for services, or any other business cooperation agreement), find information about available student competitions, open job positions, open positions for paid and/or unpaid student internships, and use educational and informational content created by Employers.

BUSINESS USER is any natural person who creates and/or has authorization to manage an Employer account and uses the Application's features intended for business users. There are two levels of business users:

  • Administrator is a Business User who has access to all account functions of the Employer, including, among other things, adding and/or removing other Business Users, changing the managerial rights of Business Users in the Employer account environment, creating and/or changing basic Employer information, and the ability to delete the Employer from the Application's database.
  • Moderator is a Business User with limited access to the functions of the Employer's account. Functions that the moderator does not have access to include adding and/or removing other Business Users, changing the managerial rights of Business Users in the Employer's account environment, creating and/or changing basic Employer information, and the ability to delete the Employer from the Application's database.

JOB POSITION is any potential establishment of an employment relationship, professional practice, internship, professional training without establishing an employment relationship, the conclusion of a service contract, or any other form of business cooperation that can be established through the Application.

DATA CONTROLLER is a natural or legal person, public authority, agency, or other body that determines the purposes and means of personal data processing, either alone or jointly with others.

3. Prava i obveze Poslodavaca

In order to use the available services of the DING application, Employers are required to create a business user account in accordance with the Terms. When registering as an Employer, it is necessary to first create a Business User account. Only a Business User can create a new Employer account. By creating a user account, the Employer accepts the Terms. The Employer is solely responsible for the confidentiality of their password. The Employer commits not to use others' access data or provide their user data to third parties. The Employer is obligated to notify the Company if they suspect unauthorized use of their access data, by email at [email protected].

Business Users, through the Employer's account, can post and/or edit job ads and/or competitions, communicate with potential candidates, use advanced application filtering features, manage the Employer's account settings (if they have an administrative account), and use other advanced application functionalities.

Business Users independently manage the content they publish. Job ads and competitions are automatically published on the application after creation. The Company reserves the right to retain ad publication for content verification. The Company reserves the right to remove ads from the application for any reason and without prior notice to the Employer. Business Users have exclusive responsibility and bear all legal consequences that may potentially result from the content of their posts on the application.

The Employer authorizes the Company to use the content published by the Employer through the application for promotional or other appropriate purposes as determined by the Company.

The Employer undertakes to use their user account on the application solely for the intended functionality of the application: (1) finding suitable employees or interns for their needs or for their clients, (2) advertising student competitions, or (3) posting content for student education purposes.

The Employer undertakes not to store data from the application's database on their computers using automated applications. The Employer undertakes not to provide or allow access to data, either directly or by giving their username and password, to third parties.

4. Rights and Obligations of Job Seekers

To use the Application, Job Seekers are obliged to create their user account through registration, in accordance with the Terms. By creating a user account, the Job Seeker accepts the Terms. The Job Seeker is solely responsible for the confidentiality of their password. The Job Seeker commits not to use others' access data or provide their user data to third parties. The Job Seeker is obligated to notify the Company if they suspect unauthorized use of their access data, by email at [email protected].

The Job Seeker is fully responsible for the accuracy and correctness of the data entered in the Application, and for the legal consequences resulting from the use of the Application.

The Job Seeker undertakes to use their user account on the Application solely for the intended functionality of the Application: (1) finding the desired job or internship, (2) reviewing available student competitions, and (3) using educational content.

5. Processing of Personal Data

By publishing advertisements through the Application, the Company becomes the Data Processor, and the Employer becomes the Data Controller regarding all personal data collected by the Job Seeker in this way and for this purpose.

The relationship between the Employer as the Data Controller and the Company as the Data Processor may be regulated by the provisions of a separate data processing agreement, which applies in conjunction with the Terms. In case a separate agreement between the Company and the Employer is not concluded, the provisions of the Terms apply, with subordinate application of the General Data Protection Regulation and the Law.

The Data Controller is obliged to implement appropriate technical and organizational measures to ensure and be able to demonstrate that data processing is carried out in accordance with the General Data Protection Regulation. The Data Controller must implement appropriate technical and organizational measures to ensure that only personal data necessary for each specific processing purpose is processed in an integrated manner. This obligation applies to the amount of personal data collected, the scope of their processing, the storage period, and their availability. More specifically, such measures must ensure that personal data are not automatically accessible to an unlimited number of individuals without individual intervention.

The valid legal basis for data collection by the Data Controller, the Employer, is the intention to find employees, trainees, volunteers, interns, scientists, or for any other type of business engagement, as well as the Job Seeker's intention to find a job. The Data Controller, the Employer, guarantees that the collected data will not be used for purposes other than those mentioned above and, in case of a breach, is liable to the Company and/or the Data Subject. Personal data is collected only to the extent necessary and appropriate to achieve the purposes mentioned above.

The Data Controller, the Employer, is obliged to cooperate with the Company as the Data Processor in the application of the General Data Protection Regulation, the collection and processing of personal data, and the exercise of the Data Subject's rights in the most appropriate way to achieve effective personal data protection.

The Data Processor is obliged to carry out personal data processing activities exclusively within the scope of providing the service and for analytical purposes of testing and improving the system.

The Data Processor is obliged to implement all necessary organizational and technical measures required for data collection and processing in accordance with the General Data Protection Regulation.

6. Consent to the Collection and Processing of Personal Data

The use of the Application and/or registration on the Application by the Job Seeker is considered as explicit consent to the Company and Employers for the collection and processing of personal data, which includes, without limitation, personal data entered by the Job Seeker through the Application, the content of resumes, cover letters, recommendations, messages exchanged in written correspondence, or any other data made available through the Application by the Job Seeker. Consent for data collection and processing is exclusively related to activities related to applying for job ads and competitions, advertising the Application, improving the service and informing about new services, improving the service and support within the Application, and promoting and improving the labor market. Personal data cannot be used for any other purpose.

The use of the Application and/or registration on the Application by the Employer is considered as explicit consent to the Company for the collection and processing of personal data, which includes, without limitation, personal data entered by the Employer through the Application, promotional materials, profile content, messages exchanged in written correspondence, or any other data made available through the Application by the Job Seeker. Consent for data collection and processing is exclusively related to activities related to advertising job ads and competitions, advertising the Application, improving the service and informing about new services, improving the service and support within the Application, promoting and improving the labor market. Personal data cannot be used for any other purpose.

Job Seekers and Employers can obtain information about the processing of their personal data, submit objections, or withdraw their consent for data processing by sending a written revocation to the address: Ding applications d.o.o., Otona Župančića 6, 10000 Zagreb, Croatia, or to the email address: [email protected], and by deactivating and deleting their user account.

In accordance with the above, I give explicit consent for the collection and processing of my personal data for the purposes explained above and agree that they will be stored until further notice or a request for erasure.

7. Limitation of Liability

The Company is not responsible for the accuracy, authenticity, credibility, or content published through the Application by Employers or Job Seekers, including, without limitation, resumes, ads, messages in correspondence between Employers and Job Seekers, the content of Employer and Job Seeker profiles, and any attached documents or other content made available to third parties through the Application by Job Seekers, Employers, or any other Application users. Employers, Job Seekers, Application users, and all third parties have exclusive responsibility for the content they publish through the Application or for content for which they have intellectual property rights that is visible or available through the Application. Employers guarantee that they own and/or have the right to use all copyright and related rights to all parts of the content published on the Application and are therefore responsible for any infringement of copyright and/or related rights resulting from the published content.

The Company is not responsible for property and/or non-property damage to Employers and/or Job Seekers regarding any use of the Application, including, without limitation, any technical difficulties, data loss, limitations in Application availability, malfunctions, or any other loss, limitation, or change in Application functionality.

Any use of the Application that is not in accordance with the Terms is considered a misuse of the Application. The Company has the right to edit the content available through the Application without limitation, remove content, refuse to publish certain categories of information, or adjust the content in a manner acceptable to the Terms and the Application's editorial policy and the Company's judgment, especially in cases where the content violates the Constitution of the Republic of Croatia, public morality, mandatory regulations, or if there is any other abuse, according to the Company's assessment. To avoid any doubt, the Company has no obligation or duty to censor, verify, or determine the truth, legality, or credibility of the content published by Employers, Job Seekers, or other users through the Application, and therefore, it assumes no legal responsibility for the content made available by Job Seekers or Employers.

8. Final Provisions

The transfer of content or part of the content available on the Application is allowed only with the explicit prior written consent of the Company and a notice that the content is taken from the Application, with an appropriate link to where the content is available.

The Company reserves the right to change the Terms for any reason at any time and without prior notice, and such changes are valid from the date of publication on DING's pages, and every Employer and Job Seeker is obliged to regularly review these Terms. The Terms, together with all amendments, apply to all Application users, both legal and physical persons.

Any disputes will be attempted to be resolved amicably by the Company, Employers, and Job Seekers, and in case of a dispute, the competent court in Zagreb has exclusive jurisdiction, and Croatian law is applicable to all legal relations between the Company, Employers, and Job Seekers.

By publishing content on the Application, the user agrees that it becomes visible to every Application visitor under the terms and conditions specified in these Terms.
